Midwest Cities See Growth in Law Firm Markets

Law firms across the American Midwest saw unparalleled growth beginning in 2019 and continuing into 2020. In fact, cities outside of Chicago saw an average revenue growth that surpassed Chicago’s throughout 2019.

A Surge in Revenue Leading Up to 2020

An analysis conducted by The American Lawyer found that Midwestern law firms in various cities other than Chicago saw a far higher growth rate in 2019 than firms located in Chicago. The analysis looked at growth across a wide range of firms, including 25 Am Law 200 firms located in the Midwest.

Seven of the Am Law 200 firms, including Ice Miller, Barnes & Thornburg, and Polsinelli, reported earning double-digit gains that year. They experienced more growth than the average 5% that the Am Law 200 saw across the country. On average, Midwestern firms experienced a growth of 7.76% in 2019, making it a landmark year for many firms in the region.

Early in 2020, Citi Private Bank’s law firm supported the data with another analysis. Their study confirmed that law firms throughout the Midwest outperformed Chicago-based firms in 2019 when it came to finances, even though Chicago is ordinarily the region’s primary commercial hub.

More Mergers Leads to Increased Financial Success

Throughout the Midwest, the country saw numerous law merger announcements in 2019, more than in any other region. Those mergers went into effect as of 2020. The mergers are likely to drive more growth for firms outside of Chicago, particularly as they involved law firms both in the Midwest and beyond to combine markets in different areas.

Many firms with reduced revenue were able to see increases in revenue by partnering with other firms, helping contribute to the health of the law firm market in the Midwest.

Another factor that helped contribute to many law firms’ success was the areas in which they practiced. Law firms branching out to multiple practice areas are more likely to see more success as they take on clients with different legal needs. For instance, a firm focusing on one practice area, like workers’ compensation, is less likely to see as much success as a firm that also handles personal injury, auto accident, and other cases.

When a teacher is accused of sexual misconduct, it’s one of the most serious accusations that warrants immediate action. Oftentimes the teacher’s union or school district is to blame for failing to fire teachers accused of misconduct and change the culture accordingly. In many cases, educators even work to cover up accusations to protect their reputations.

Covering Up Child Abuse and Keeping Abusers in Schools

In states across the country, teachers, administrators, and other school staff are required to notify authorities of any accusations or suspicions of teacher sexual misconduct involving underage students. Despite this requirement put in place to protect students, some faculty members are instead opting to cover up these instances of abuse to protect co-workers or the reputation of the school or district at large.

The Southern California News Group recently uncovered widespread abuse cover-ups taking place in Southern California, examining around 1,900 pages worth of documents along with hours of interviews with police. The investigation uncovered a pattern of concealing sex abuse cases that had started over a decade earlier.

Many experts assert that the problem persists across the nation beyond California, as other districts have been found to have covered up allegations of sexual misconduct.

When School District Culture Is to Blame

Teacher sexual misconduct occurs when a teacher sexually abuses a child while the child is in the care of that teacher in a K-12 school setting. According to research from Magnolia Consulting, one in every 10 students will suffer sexual misconduct before graduating from high school. Despite the prevalence of abuse, staff who fail to report any suspicions of abuse rarely face criminal charges.

Even when teachers are accused of sexual misconduct, they often don’t lose their jobs due to the protection of some teachers’ unions. In fact, a combination of a union’s advocacy and laws have helped protect many abusers, as those laws often beget additional laws.

In some cases, both districts and unions accuse each other of allowing abusers to remain unpunished. While some school district officials state that they are required to keep accused teachers employed due to certain teachers’ union contract clauses, unions may claim that the school district has the ability to fire educators as needed.

Another investigation by Voice of San Diego helped uncover additional problems with school districts in San Diego. The investigation found that public school districts in the San Diego area enable teachers accused of misconduct to stay employed, even after allegations are supported by an investigation. Instead of firing teachers, districts may either choose to transfer accused employees to other schools or give them the ability to voluntarily resign or retire. In turn, the district remains quiet about the reasons for letting the teacher go.

Teachers’ unions across the country have also helped protect teachers in many situations, whether facing a sexual abuse case, a personal injury lawsuit, or another situation. Unions often fight to protect teachers from accountability, with contracts that can make it extremely difficult to fire senior staff.

Is a casino always liable when you slip and fall?

Casinos are not liable for every incident that results in slip and fall accidents. Although the casino management is required to maintain safe facilities, they are only responsible for protecting patrons from incidents that they know or should know can lead to harm. The key to holding casinos liable proving that the management or employees acted negligently in some way and the negligence led to the injury.

Proving Casino Liability

Casinos are required to do whatever is reasonably possible to protect patrons from foreseeable conditions that could cause injuries. For instance, if a person slips on a liquid that has just been splashed or spilled by another patron, the casino is unlikely to be liable because it is not reasonable to expect casino employees to clean every spill immediately.

Similarly, the casino may not be liable if a patron slips and falls on a slippery floor where a wet floor sign has been placed.   1. The casino had a duty to protect him or her from injury.
  2. The management knew or reasonably should have known about the hazardous situation.
  3. The casino failed to correct the danger, thus was negligent.
  4. This negligence caused the injury.
  5. The injury has been confirmed.

Can I get disability benefits for injuries sustained in a car accident?

Victims who suffer severe car accident injuries may be entitled to Social Security Disability benefits if they can no longer work or if their ability to work is compromised after the crash. While there is a heavy focus on the recovery of immediate compensation in a court case, the extensive process of applying for SSDI is often overlooked. Knowledge of all of the benefits available to victims is crucial as a person begins to regain control of his or her life.

Understanding SSDI Benefits

Social Security Disability Insurance is a payroll insurance program funded by the federal government through taxes. Managed and maintained by the Social Security Administration (SSA), SSDI’s main purpose is to provide financial relief to those who find themselves greatly reduced in their work capacity due to physical or mental disabilities. The cause of these disabilities, whether the result of an ongoing condition since birth or a recent injury accident, matters very little as long as up to five questions can be answered to the SSA’s satisfaction. The questions are as follows:

  1. Is the claimant performing substantial gainful activity?
  2. Is the claimant’s impairment severe?
  3. Does the impairment meet or equal the severity of the impairments in the Listing of Impairments?
  4. Is the claimant able to perform past work?
  5. Is the claimant able to perform any work in the economy?

Once the questions are answered to their satisfaction, the SSA provides monthly SSDI benefits to the individual. The amount a person with a disability receives is based on a portion of past earnings. These benefits may take a considerable amount of time to acquire, especially if there is an appeal or reconsideration.

If an injury is not listed within the SSA’s Listing of Impairments, the victim may still qualify for benefits if it is established that the disability is medically equivalent to one in the listing. A doctor is often enlisted to assist with creating a residual functioning capacity form (RFC) to determine the severity of the impairment. This can be a practitioner enlisted by the SSA or the treating doctor of the claimant. The RFC is determined by evaluating the workload the individual can complete easily, ranging from heavy factory work to sedentary work. Usually, one needs to be scored as less than capable of performing sedentary workloads. Exceptions for the rules exist. If the applicant is over the age of 55 or cannot change jobs due to a lack of education or formal training, then that is taken into consideration.

Victims do not need to have a permanent injury for the Social Security Administration to approve the disability checks. If the disability is severe enough to prevent an individual from performing substantial gainful activity for at least twelve months, then the person is likely eligible to receive benefits from the SSA to compensate for lost wages in the short term. For individuals who are able to work, but must accept a position with significantly reduced wages due to impairments from the car accident, some benefits may still apply.

It would be simple to see a house as shared marital property, especially if both spouses are included in the mortgage. However, the shared marital property could also include property that technically only has one name from the partnership on paper.

Changes in Asset Value

An additional factor to consider is appreciation, both active and passive. Active appreciation is an addition to the value of assets through direct action, such as deposits and contributions towards investments. These are easy to track with proper documentation. Passive appreciation is the result of outside forces influencing an asset’s value, such as a market supply and demand, inflation and devaluation. Real estate lawyers are keenly aware of these factors and can be an asset in property valuation during divorce proceedings.

Asset Distribution

Redistributing assets is by no means an easy action to take. When it gets down to the matter, dividing up sentimentally valued property and financial holdings accumulated as a team is an exceptionally emotional event. This process can quickly become emotionally charged with everything else that is going on during a divorce. When personal items are thrown up for evaluation, it can leave feelings of bitterness should negotiations break down, and the goal switches from amicable separation to trying to get the best deal from the transaction. As such, a family home can quickly become a difficult asset to divide.

Separating couples can choose to handle this asset in different ways. First, the divorcees can choose to sell the home and divide the profit equally. This is the simplest way to divide the equity of the home. If one spouse does not wish to abandon the family home, he or she can refinance the mortgage to remove the name of the former spouse. This means that the home is no longer a shared asset as the old debt is replaced with a new loan. The spouse retaining the property may need to buy out the other person’s share of the equity. Finally, the asset may continue to be shared. This is a viable option for partners who choose a nesting method for child custody.
